Can you legally charge late payment interest?

Yes — if the rate and trigger are clearly mentioned in your contract, purchase order, or on the invoice itself. Without prior notice, courts may not enforce the late fee.

MSMED Act protection for small suppliers

If you're a registered MSME, the Micro, Small and Medium Enterprises Development Act mandates payment within 45 days. Beyond that, the buyer must pay compound interest at 3x the bank rate notified by RBI.

Reasonable interest rates

Typical industry practice: 1.5%–2% per month (~18%–24% annualised) for B2B. Banking rates apply for MSMEs under MSMED. Anything above 24% may be seen as usurious.

How to communicate it

On every invoice footer: "Interest at 1.5% per month will be charged on payments not received within 30 days from the invoice date." Send a written reminder 7 days after due date before applying interest.
