Why Penalties Pile Up Quickly Under GST

The Indian GST system is highly automated, which is good news for compliant taxpayers and bad news for those who miss deadlines. Late filing of GSTR-1 or GSTR-3B attracts a per-day late fee, interest on tax dues accrues at 18 percent annualized, and missed e-way bills can trigger detention with hefty penalties at the checkpost. Unlike the older indirect tax regime, almost every default is detected automatically and the consequence is mechanical, not discretionary. Building a calendar of monthly deadlines is the single biggest defensive habit a GST taxpayer can develop.

Late Fees on Return Filing

Under Section 47 read with Notification 76/2018, late fees on GSTR-3B and GSTR-1 are Rs. 25 per day for CGST plus Rs. 25 per day for SGST (Rs. 50 total) for returns with tax liability, and Rs. 10 plus Rs. 10 (Rs. 20 total) for nil returns. The fee is capped at Rs. 5,000 per return for normal returns and lower amounts for nil returns depending on turnover. GSTR-9 annual return attracts a much heftier Rs. 200 per day capped at 0.25 percent of turnover. These are mechanical and cannot be waived by the officer.

Interest on Tax Liability

Section 50 of the CGST Act levies 18 percent interest per annum on any tax paid after the due date and 24 percent per annum on undue or excess ITC claim. Interest is computed day-wise from the date the tax was due till the date of payment, not month-wise. Even a one-day delay attracts a full day of interest, which is why settling GSTR-3B liabilities before the 20th matters so much. Interest is paid through challan in DRC-03 and reported in the next GSTR-3B.

Penalties for Genuine Errors and Wilful Default

Section 73 covers cases of tax not paid or short-paid without fraud or wilful misstatement, with a penalty of 10 percent of the tax or Rs. 10,000, whichever is higher. Section 74 covers fraud and wilful misstatement, with a penalty of 100 percent of the tax. If you voluntarily pay the tax and interest before a Show Cause Notice is issued, the penalty under Section 73 drops to nil and under Section 74 to 15 percent.
