Why GST Notices Are More Common Than You Think
With end-to-end digitization of returns, the GST department now issues automated notices for the smallest mismatches, ITC vs GSTR-2B differences, GSTR-1 vs GSTR-3B gaps, e-way bill anomalies, or simply non-filing for a few months. A notice is not an indictment, but ignoring one almost always escalates the matter. Every notice carries a strict response deadline, typically 15 to 30 days, and the GST portal is the only valid channel for replies. Treat every notice as actionable on the day it arrives, not the week before the deadline.
ASMT-10 Scrutiny Notice and ASMT-11 Reply
Form ASMT-10 is issued by the proper officer under Section 61 when scrutinizing your returns and noticing discrepancies, for example, ITC claimed exceeding GSTR-2B or outward supply gaps between GSTR-1 and GSTR-3B. You have 30 days (extendable on request) to file ASMT-11 explaining the discrepancy or paying the differential tax with interest. If the officer is satisfied with your explanation, the matter is closed via ASMT-12. If not, it escalates to a Show Cause Notice under Section 73 or 74.
Show Cause Notice (SCN) and DRC-01
A Show Cause Notice in DRC-01 is issued under Section 73 (no fraud) with a three-year limitation or Section 74 (fraud or wilful misstatement) with a five-year limitation. The notice quantifies the alleged tax demand along with interest and penalty. Section 73 cases attract a 10 percent penalty (or Rs. 10,000, whichever is higher) while Section 74 cases attract 100 percent penalty. You can avoid the SCN entirely by paying the tax with interest before issuance, in which case no penalty applies. Once the SCN is issued, the response in DRC-06 must be filed within 30 days.
Drafting a Strong Reply
A strong reply starts with a clear chronological narrative of the facts, attaches every relevant document (invoices, bank statements, ledger extracts, GSTR-2B printouts), and cites the exact statutory provisions and case law you rely on. Where the department alleges ITC ineligibility, reproduce the supplier GSTR-1 entry, the payment trail, and Section 16 conditions point-by-point. Where you have made a genuine error, accept it, pay the tax with interest immediately, and attach proof of payment. Officers respond well to organized, document-heavy, calmly worded replies.
