Why Advances Exist and What They Signal
Asking for an advance is not just about cash, it is a commitment signal that filters serious buyers from time-wasters. For project-based services and made-to-order goods, 30% to 50% advance is the industry norm in India, with the balance staggered against milestones or delivery. A zero-advance arrangement should be reserved for repeat customers with a clean payment history, or where the buyer is a large corporate that simply does not pay advances as policy. New-customer projects with no advance are the leading cause of working capital stress in service businesses.
Structuring Milestone-Linked Advances
For projects above two months in duration, split the payment into advance, mid-project milestone and final delivery, with no tranche less than 20% of total value. Each milestone should map to a specific deliverable, like wireframes approved, prototype delivered, or installation complete, not to a calendar date. Vague time-based milestones lead to disputes when the buyer delays approvals on their side. Tying tranches to written sign-off on a defined artefact gives you a clean trigger to invoice and collect.
GST on Advance: The Service Trap
Under GST, advance received against the supply of services attracts GST in the month of receipt, even though the service is not yet rendered. You must issue a receipt voucher, pay tax in that months GSTR-3B, and adjust it when the final tax invoice is raised. For goods, the government removed GST on advance receipts in 2017, so only the final invoice needs reporting. Many service businesses forget the receipt voucher requirement and end up with interest and late fees when the audit catches it.
Protective Clauses to Always Include
Your contract or purchase order should state that the advance is non-refundable once work has commenced, with a clear definition of commencement like resource allocation or material procurement. Add a clause that delays in buyer approvals shift the delivery date one-for-one, protecting you from penalty clauses on calendar slippage. Specify a final payment due date with interest at 1.5% per month on overdue amounts, citing the MSMED Act if you are registered as MSME. Finally, retain title and IP until full payment, especially for design, software and custom hardware deals.
