## When Internal Recovery Fails

Most SMBs hand over receivables to a collection agency only after 90 to 120 days of internal follow-up with reminders, calls and lawyer notices have failed. The decision usually comes down to opportunity cost, your sales team chasing old dues earns far less than focusing on new revenue. A collection agency is worth engaging when the receivable is at least Rs 1 lakh, the debtor is solvent, and the contractual paperwork like invoices, delivery proofs and emails is in good order. ## Commission Structures and Norms

## Choosing an Agency Carefully

Recovery agents in India operate under RBI guidelines for banking debts and various state laws otherwise, and aggressive tactics like phone harassment or visiting customer premises can backfire badly on your brand. Pick an agency with documented processes, written communication templates, and a track record in your industry. Avoid agencies that promise miraculous recoveries without legal backing, since their tactics often violate IT Act provisions on harassment. Speak to existing clients before signing, and start with one or two test cases before handing over a full portfolio.

## The MSMED Council Alternative

If you are registered as MSME, filing a complaint with the MSME Samadhaan portal under the MSMED Act 2006 is free and powerful. The matter goes to the Micro and Small Enterprises Facilitation Council in your state, which first attempts conciliation and then proceeds to arbitration if conciliation fails. The Act mandates interest at three times the bank rate compounded monthly, and the buyer cannot challenge the award without depositing 75% of the awarded amount. For organised buyers with reputational concerns, the threat of an MSME Samadhaan filing alone often unlocks payment within weeks.

## Other Legal Routes Worth Knowing

For amounts up to Rs 1 crore against a corporate debtor, the National Company Law Tribunal route under IBC Section 9 used to be effective until the Rs 1 crore threshold was set in 2020, making it less accessible for smaller dues. A summary suit under Order 37 of CPC is faster than a regular civil suit and works well for clear-cut commercial debts with written acknowledgement.
